1. About the service
easyKSB (“the Service”) is operated by Grayscaled Ltd, registered in England and Wales (company number: 17017057), with registered address at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. Website: grayscaled.dev.
The Service provides AI-powered mapping of apprenticeship evidence against Knowledge, Skills, and Behaviours (KSBs) from apprenticeship standards. By creating an account or using the Service, you agree to these terms and our Privacy Policy.
2. Eligibility
You must be at least 16 years old to use the Service. If you are aged 16 or 17, you confirm that you have consent from a parent or guardian, or are using the Service as part of an apprenticeship programme supervised by a training provider.
3. Accounts
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating an account.
- One account per person. Accounts are non-transferable.
- You must notify us promptly if you become aware of unauthorised access to your account.
- We reserve the right to suspend or terminate accounts that violate these terms, with notice where reasonably practicable.
4. Subscriptions and billing
- Free tier: limited to 5 evidence uploads total with basic features.
- Pro and Pro+ tiers: paid subscriptions billed monthly or annually in GBP via Stripe.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You can cancel at any time through the billing portal. Access continues until the end of the current billing period. No partial refunds are given for mid-period cancellations.
- Refunds are available within 14 days of initial purchase if you have not extensively used the Service (defined as fewer than 5 evidence uploads). Contact [email protected].
- We reserve the right to change pricing with 30 days' notice via email. Existing subscriptions are honoured at the current price until the next renewal date after the notice period.
- If payment fails, we will retry in accordance with Stripe's dunning schedule. After repeated failures, your subscription may be downgraded to the free tier.
5. Your content and data
- You retain full ownership of all evidence, documents, and text you upload.
- You grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the Service (KSB matching, embedding generation, coverage analysis, and export generation). This licence terminates when you delete your content or close your account.
- You are responsible for ensuring you have the right to upload any content. Do not upload confidential employer documents without permission, or content belonging to other apprentices.
- You can delete your content at any time via the dashboard. Deleted content is permanently removed from our systems within 30 days.
- Your evidence text is sent to third-party AI providers (OpenAI and Anthropic) for processing. These providers do not retain your content. See our Privacy Policy for full details.
- We do not use your content to train AI models, and we do not share your content with other users.
6. AI-generated output
- KSB matching results, confidence scores, and reasoning are generated by AI and are indicative, not definitive. They should not be treated as professional assessment.
- The Service does not guarantee EPA outcomes, and we accept no responsibility for assessment results or gateway decisions influenced by our output.
- Results should be used as a guide alongside advice from your training provider, employer, and End-Point Assessor.
- AI-generated reasoning text is provided as a starting point. You should review, verify, and personalise any text before including it in a portfolio. Submitting AI-generated text as your own work without review may breach your apprenticeship agreement.
- We continuously improve our matching but cannot guarantee accuracy. Confidence scores are relative indicators, not percentages of correctness.
7. Acceptable use
You must not:
- Use the Service to fabricate evidence or misrepresent your competence to assessors, employers, or training providers.
- Upload content that is illegal, harmful, defamatory, or infringes third-party intellectual property rights.
- Upload content containing sensitive personal data about third parties (e.g. service users, patients, clients) without appropriate anonymisation.
- Attempt to reverse-engineer, decompile, scrape, or exploit the Service or its underlying algorithms.
- Share account credentials or allow others to use your account.
- Use automated tools, bots, or scripts to access the Service beyond normal usage patterns.
- Circumvent usage limits, rate limiting, or access controls.
- Resell or commercially redistribute any output from the Service.
Violation of these terms may result in immediate account suspension or termination without refund.
8. Availability and changes
- We aim for high availability but do not guarantee uninterrupted access. The Service is provided on an “as is” and “as available” basis.
- We may modify, suspend, or discontinue features with reasonable notice. For material changes that reduce paid functionality, we will provide at least 14 days' notice.
- Scheduled maintenance will be communicated in advance where possible.
- We are not liable for any loss or inconvenience caused by downtime, whether planned or unplanned.
9. Termination and data on account closure
You may close your account at any time through your account settings. We may also terminate your account for breach of these terms.
On account closure:
- Your active subscription (if any) will be cancelled. No refund is given for the remaining billing period.
- All evidence, matches, embeddings, and account data will be permanently deleted immediately.
- Billing records will be retained for 7 years as required by HMRC.
- We recommend exporting your coverage data before closing your account, as deletion is irreversible.
10. Limitation of liability
To the fullest extent permitted by law, Grayscaled Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to EPA outcomes, lost opportunities, loss of data, or reliance on AI-generated content.
Our total aggregate liability for any claim arising from or relating to the Service is limited to the amount you have paid us in the 12 months preceding the event giving rise to the claim, or £50, whichever is greater.
Nothing in these terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited by English law.
11. Indemnity
You agree to indemnify Grayscaled Ltd against any claims, damages, or expenses arising from: your breach of these terms; your upload of content that infringes third-party rights; or your misuse of AI-generated output (including presenting it as your own original work in a professional or assessment context without review).
12. Intellectual property
- The Service, its design, code, algorithms, and branding are owned by Grayscaled Ltd and protected by copyright and other intellectual property laws.
- Apprenticeship standards and KSB definitions are sourced from Skills England (formerly the Institute for Apprenticeships and Technical Education) and are Crown copyright or the intellectual property of Skills England. We reproduce them under fair dealing for the purpose of providing the Service.
- You retain full ownership of your uploaded content and any personalised portfolio text you create using the Service.
13. Dispute resolution
If you have a complaint, please contact [email protected] first. We will endeavour to resolve disputes informally within 14 days. If we cannot reach a resolution, either party may pursue formal proceedings.
14. Force majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or power outages, failures of third-party services (including AI providers, payment processors, or hosting providers), pandemics, or industrial action.
15. General
- Entire agreement: these terms, together with the Privacy Policy, constitute the entire agreement between you and Grayscaled Ltd regarding the Service.
- Severability: if any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
- Waiver: our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
- Assignment: we may assign or transfer our rights under these terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our written consent.
- No third-party rights: these terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.
16. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have rights under the laws of the country in which you reside.
